Gesundheitsdatenschutzrecht ist kein eigenständiges Rechtsgebiet, sondern Datenschutzrecht in einem besonders sensiblen Umfeld: Verletzungen bedrohen nicht nur unmittelbar die physische und psychische Unversehrtheit Betroffener, sondern sind häufig auch strafrechtlich relevant. Verstöße gegen das Datenschutzrecht werden zukünftig hart bestraft. Die neue europäische Datenschutz-Grundverordnung sieht Bußgelder von bis zu 20 Millionen Euro bzw. 4 % des Jahresumsatzes vor – je nachdem, was höher liegt.
